Statement from Noreen Farrell, Executive Director of Equal Rights Advocates, which fights for gender justice in workplaces and schools across the country

Feb. 25, 2022 — Texas Gov. Greg Abbott’s recent directive to state health agencies and the general public to investigate gender-affirming health care for trans youth as child abuse, and report the parents of minors appearing to receive gender-affirming medical care, is a draconian attempt to weaponize the law against families with transgender and nonbinary children. 

Should this directive gain traction, it would further endanger transgender youth who already face unacceptable instances of hate and discrimination. What’s more, those hit hardest would be trans children of color, who are the most vulnerable to extra and unnecessary contact with the foster system.

There is no legal basis for equating gender-affirming care with child abuse. It allows a child to use the name and pronouns that fit their identity, to wear the clothes that affirm them, and be treated as the gender they assert is correct. This kind of care is an important form of support and it is vital to the health and happiness of trans youth. As a nation, we decided long ago that gender discrimination is wrong—and that must include transgender kids.
